The Trump administration filed an immediate appeal after U.S. District Judge David Leibowitz ruled that Congress lacks the constitutional authority to prohibit noncitizens from voting in federal elections. Leibowitz, a Biden appointee in South Florida, said states - not Congress - hold the power to set voter qualifications.
The ruling dismissed the federal misdemeanor case against Chelsea Cox, a Jamaican citizen accused of voting in the 2020 election. Prosecutors said Cox had used a false birth certificate to obtain a Florida driver’s license, registered to vote in 2012, and cast ballots in several elections. Only the 2020 vote was charged because of the statute of limitations.
Leibowitz’s decision currently applies only to Cox’s case, but the administration argues its reasoning could threaten other federal prosecutions involving noncitizen voting. The Justice Department has opened more than 60 such cases since January 2025, according to the report.
Legal scholar Hans von Spakovsky of Advancing American Freedom said he expects an appeals court to overturn the decision, arguing that Congress’ authority over immigration supports the federal ban. Leibowitz said states may still bar noncitizens from voting and noted that Congress may impose immigration consequences, including deportation, for noncitizens who vote.
