The Department of Homeland Security has issued new guidance allowing immigration officers to arrest and detain refugees who have been in the United States for more than one year but have not obtained lawful permanent resident status. Under federal law, refugees are required to apply for permanent residency after one year of arrival.
·According to the directive filed in federal court, refugees who have “failed to adjust” to lawful permanent resident status may be taken into custody and held for the duration of the inspection and examination process while their cases are reviewed for compliance, fraud concerns, or national security issues.
·The policy rescinds prior internal guidance that treated failure to obtain a green card after one year as insufficient grounds for detention on its own. The directive was signed by senior officials at U.S. Citizenship and Immigration Services and Immigration and Customs Enforcement and is currently the subject of litigation in federal court.
