A dangerous precedent for all of us...

Some conservative voices - mine included - were quick to criticize Bondi’s remarks because we believe the 1st Amendment, short of shouting 'fire', is pre-eminent, even if you disagree with what's being said.
Online critics highlighted her X post contending that “Hate speech does not exist legally in America.” After facing blowback, Bondi clarified that she will target “hate speech that crosses the line into threats of violence,” which she said “is NOT protected by the First Amendment.”
 
Is that statement, in itself, a crime? Would she be targeted?

Hate speech is just that - speech. Threats are different, but short of carrying out those threats, is it an actual crime? Worth pondering, for sure. 
It does worry me a bit...

  3. Bondi could (and should) have phrased her comments better. She invited misinterpretation, needlessly. That said, she -like Trump - simply paraphrased the actual statute, which says that making threats of harm are actionable under the law. The threat must be targeted and explicit ("I will kill Brett K") but it's pretty easy to cross the line. And those kinds of threats should be actionable; when someone says they intend to kill or harm you, believe them.

  4. The idea of "hate speech" worries quite a few of us who've lived long enough to understand that we need to allow all speech in a democracy/(republic), even yelling "Fire" in a crowded theater: threats are something else and should be dealt with accordingly.

    The answer to this is yes, if the threat is capable of being carried out in the moment ... like a man holding a knife in your presence and saying he's going to stab you. Like assault, all that is needed is the creation of credible immediate fear or apprehension. As opposed to someone saying that to you on Twitter, or over the phone.

  7. Hate speech is still Free Speech.

    That one statement disqualifies her from holding the job she currently holds.

    Should be fired immediately for saying that...either because she thinks it is the right thing to do, or because she was stupid enough to say it.

  8. The problem with hate speech laws is they fail the "what if the other guy had that power" test. If your position would change based on if Obama v. Trump has control of enforcing that law, it is a bad law.
