ReplyDeleteGovernor's Island, Ellis Island, and Liberty Island were once known as the Oyster Islands, and were part of New Amsterdam. England took over New Amsterdam in 1664. Originally called Noten Eylandt (Nutten Island) by the Dutch, it is prime real estate just offshore from the World Trade Center, yet nobody lives there. There was a battery there once, called Fort Jay.

Ellis Island and Fort Gibson became New York property in 1808 when the Ellis family sold the property to NY. The fort was built in 1795. NY later transferred ownership to the federal government.
The island, originally known as Little Oyster Island, has been under the jurisdiction of New York since around 1691.

Control of Bedloe's Island, much later renamed Liberty Island, was ceded to the federal government in 1800 by the state of New York. It had been owned by a citizen of New Amsterdam originally, and later changed hands several time, sold to and by several New York residents in early Colonial days. It has NEVER been part of New Jersey.

In 1834 NY and NJ reached an understanding about Liberty Island and Fort Wood. The waters and the bottom of the bay around both islands is NJ. The National Park Service owns both islands and what's on them these days.
Both forts were given their current names years after they were built, to honor soldiers who fell in the war of 1812 in the Lake Erie battles. Lake Erie abuts New York and is nowhere near New Jersey.
Disputes between states have original jurisdiction in the US Supreme Court. Apparently neither state is serious enough to file for a writ of certiorari if this is going "on for years."
