The Supreme Court on Thursday sided with Jack Daniel’s in a dispute over a
poop-themed dog toy that parodies its iconic liquor bottle, ruling that a lower court erred when it said the toy was covered by the First Amendment’s free speech protections.
The unanimous opinion written by Justice Elena Kagan allows the liquor maker to revive its trademark lawsuit against VIP Products in lower courts. In the meantime, the “Bad Spaniels Silly Squeaker” toy remains on the market.
At the center of the case is the toy created by VIP Products that is strikingly similar to Jack Daniel’s bottles. The distiller sued the company over the toy – which is replete with scatological humor – claiming it violated federal trademark law, which usually centers around how likely a consumer is to confuse an alleged infringement with something produced by the true owner of the mark.

Donald Trump could face up to 100 years behind bars if convicted on all seven counts, according to ABC News. The indictment remains under seal but sources detailed its contents, and his lawyer, Jim Trusty, told CNN that all seven charges 'break out from an Espionage Act charge'. Trump, who's currently at his Bedminster golf club in New Jersey, pre-recorded a video condemning the charges before learning of them. California Gov. Gavin Newsom proposed Thursday adding a 28th Amendment to the U.S. Constitution, which he said will address the country's gun violence crisis. The amendment would raise the minimum age to purchase a gun from 18 to 21, mandate universal background checks, institute a reasonable waiting period for all gun purchases and bar civilians from purchasing assault weapons.
Raising the age to 21 is realistic and do-able,

Mis-labeling semi automatic weapons like AR's is misleading at best, and if the definition of 'assauly weapons was stretched just the least little bit, it would also include all semi-automatic handguns, so no - that's a stupid idea, and besides, even though ole' Gavin thinks it's a reasonable idea,

ReplyDeleteI saw Tina Turner twice in close succession because I took a tasty work colleague after my wife traded up and felt obliged to take my girlfriend whom I'd begun being intimate with between the bookings. Two great concerts although a back up singer sprained an ankle on each occasion. Tina Turner was a class act.
